This document regulates the terms and conditions of use of this website and the agreement established between FarmaOli and the Customer. These Terms establish the rights and obligations of all users and FarmaOli in relation to the goods/services made available on this website or on any other website to which there is a hyperlink/link.
Before finalizing an order, you should read these Terms carefully. If you do not agree with them in their entirety, you should refrain from making any purchase.
These Terms are subject to change, so you should read them before placing any order. If you have any questions about these Terms, you should contact us by email at info@farmaoli.com.
These Terms are important for both parties, as they aim to protect the rights of the user, as a customer, as well as our rights as FarmaOli and are intended to establish a legally valid agreement between the parties involved.
By placing an order, the user confirms that he/she has read these Terms, which he/she accepts without reservation.
The user agrees that:
You may only use this website to make inquiries or orders that are legitimate. You will not place orders that are speculative, false or fraudulent. If we have reasonable grounds to believe that a particular order is of such nature, we reserve the right to cancel it and inform the competent authorities.
You are required to provide an email address or other contact details that are correct and complete and you agree that FarmaOli may contact you using these details if deemed necessary. If you do not provide all the information deemed necessary, it may not be possible to complete your order and/or guarantee a quality service.
The information contained in these Terms does not constitute a sales proposal, but rather a mere invitation to negotiate. No contract relating to the products mentioned will be established between FarmaOli and the User without the order having been accepted by the former (regardless of whether or not a debit has been made to the User's account). If the order is not accepted after any debit has been made, the respective amount will be refunded in full.
When placing an order through this website,the user declares that he/she is over 18 years of age and has the legal capacity to enter into contracts.
1. Obligations of Customers and Users
Any visitor to the website www.farmaoli.com undertakes to comply with and respect these general conditions, namely:
- To keep and not disclose their password for accessing the website, in order to prevent third parties from accessing their account and personal data;
- Not to use false identities;
- Provide your correct personal data and addresses so that orders can be processed properly;
The customer is solely responsible for the accuracy of the personal data communicated to Farmaoli and undertakes to immediately enter and report any changes through their Registration Account at www.farmaoli.com.
Farmaoli disclaims any responsibility for any delay or inability to process the order due to an error or insufficiency in the data provided by the ‘End Consumer’, particularly at the time of delivery.
2. Information on the products sold
All products sold by FarmaOli are 100% genuine, purchased directly from manufacturers, and comply with European standards and formulas. We emphasise that European cosmetic formulations may differ from those available in other regions. Customers should be aware of these possible differences when placing an order, as FarmaOli does not issue refunds for such variations, unless the product is proven to be defective or differs from the description. This policy recognises regional differences in product formulations and packaging, which are common in the cosmetics industry.
The information on the website may contain typographical errors or inaccuracies and may not be complete or up to date. We therefore reserve the right to correct errors, inaccuracies or omissions, and to change and update information at any time without prior notice (including after an order has been placed). Please note that such errors, inaccuracies or omissions may relate to the description, price and availability of the product. We apologise for any inconvenience this may cause. If you are not completely satisfied with your purchase, you can return it under the conditions in force. Please refer to the Return Policy (Returns and Refunds).
The photographs shown on the website are for illustrative purposes only, intended to help identify the type of product, but may not accurately represent the product received.
Manufacturers frequently update product packaging, and as such, there may be differences in appearance, packaging language or ingredient list. In addition, the colours in the photographs may not match the actual colours of the products, and may also vary depending on the screen. Therefore, you should always consult the product description for more information about the characteristics of the items you wish to purchase.
For questions about a product, including details about ingredients or packaging, we recommend that customers contact our customer support team before placing their order at info@farmaoli.com.
By purchasing from FarmaOli, customers acknowledge and accept these Terms, confirming that they are aware that product images and descriptions may vary from the products received due to updates and regional differences.
For proof of offer, discount or internal control, products may be shipped without a barcode and/or CNP. If you do not want these elements to be removed, you should contact FarmaOli before making your purchase.
3. Prices
FarmaOli offers a conversion service for various currencies. This service is provided for information purposes only. Your purchases are always charged in euros.
The prices of the products displayed on the website include Value Added Tax (VAT) and are correct at the time the information is entered into the system. However, we reserve the right to change prices at any time without prior notice.
If the price displayed on the checkout page is incorrect, we are not obliged to sell the products at the displayed price. We strive to ensure that the prices of the products displayed on our website are correct, however, errors may occasionally occur. If we detect an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the correct price or request cancellation. If we are unable to contact you, the order will be cancelled and you will be refunded the full amount of the order, if you have already paid for it.
We reserve the right to refuse orders based on their size or value.
If you cancel your order and have already paid for the products, you will receive a full refund.
Please note that all campaigns and promotions are limited to existing stock and are not cumulative.
Shipping costs will be borne by the customer and the amounts will be indicated at the time of ordering.
4. Value Added Tax
In accordance with current rules and regulations, purchases made through this website are subject to Value Added Tax (VAT). The Portuguese VAT rate is applied to orders placed by private consumers residing in Portugal or any other European Union country.
Although rare, a customs duty may be charged in the destination country in accordance with the laws in force in that country. Payment of this duty is the sole responsibility of the customer.
5. Payment Methods and Security Guarantees
The available payment methods are: PayPal, Credit Card, Revolut, and Bank Transfer (IBAN PT50.0033.0000.45591082036.05).
You can pay with Visa and MasterCard cards or through a PayPal or Revolut account.
By making the payment, the user confirms that they are the cardholder or PayPal or Revolut account holder, and the authorised amount will be debited at that time.
Credit cards are subject to validation and authorisation by the issuing entities, but if the card issuer does not authorise the payment, FarmaOli will not be liable for any delay or non-delivery and may not enter into the Contract with the user.
We will only begin processing the order after we have received payment.
6. Placing an order
To place an order, customers must have a valid and frequently used email account and register as a customer by filling out the form available online. Once registered, simply add all the products you wish to purchase to your virtual shopping basket and follow all the steps to complete your purchase successfully.
As soon as you complete your purchase, you will receive an automatic email confirming your payment. We suggest that you print or download it. If the details are incorrect, you can immediately request a change or even cancel the purchase.
In the event of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, FarmaOli reserves the right not to accept your order, or to cancel it in whole or in part, even after automatic confirmation of the order.
7. Product availability
FarmaOli only processes orders placed by customers after confirmation of payment.
Information about product availability refers to the moment the customer makes the purchase. Only after confirmation of payment is the final validation of stock availability made. It is therefore advisable that payment be made immediately after placing the order.
The fulfilment of all orders placed on the website is subject to product availability. FarmaOli reserves the right not to accept any orders or to cancel orders already confirmed for products that are out of stock. In the event of product unavailability and/or stock shortage, FarmaOli will inform the customer of the partial or total cancellation of their order, and the customer is entitled to a refund of the respective amount paid.
8. Confirmation or cancellation of orders
FarmaOli will cancel orders when the customer fails to make payment within the stipulated period, when the order is incomplete or incorrect, or when the products ordered are no longer available. In any of the above cases, FarmaOli will inform the customer by email that the sales contract has not been concluded and that FarmaOli has not proceeded with the sale, specifying the reasons for this.
If an order has been placed and paid for products that have since become unavailable, FarmaOli will refund the amount paid for the unavailable items.
FarmaOli reserves the right to refuse any order, regardless of the reason, and is exempt from liability for any damages or costs, as well as reserves the right to cancel any purchase even if it has already been accepted or confirmed by FarmaOli, namely in the following situations:
- The information contained in the customer file is incorrect or unverifiable;
- Payment for the order has not been made
- When it is not possible to deliver the order to the address provided by the customer;
- If there is an error in the price of the product(s)
Before shipment, the customer may request cancellation of the order. If the customer places an order and wishes to cancel it, they must first check the status of the order through the ‘Order History’ menu. If the order status does not say ‘Shipped’, then it may still be possible to cancel it. To do so, the customer must contact FarmaOli by email and request cancellation of the order. The cancellation will only be effective after confirmation by FarmaOli.
If the cancellation request is successful, the customer will be notified of this decision by email and the cancellation will be processed.
If the cancellation request is not possible because the order has already been shipped, the products will be sent to the customer who, if they maintain their intention, must exercise their right to freely terminate the contract.
For reasons of health protection, hygiene, susceptibility to deterioration and impossibility of return, food supplements, food and medical devices are exceptions to the right of free termination.
Whenever orders are cancelled at the customer's request, the usage fee charged by FarmaOli to the entities subcontracted for payment will be deducted from the amount to be refunded.
Whenever orders are cancelled at the customer's request, the refund will be made using the same payment method used in the original order. The bank charges associated with the refund are borne by the customer. In other words, you will receive the amount paid minus the costs involved in the transfer.
9. Preparation and Delivery of Orders
Unless otherwise agreed between the parties, FarmaOli will fulfil the order within a maximum period of 30 days from the day following the effective payment of the order.
Shipments do not include the time related to the procedures of carriers that are caused by an event, act or omission beyond their reasonable control.
Only orders worth more than €10, excluding VAT, will be processed.
Once your order has been registered and payment confirmed, the order will enter the preparation phase. This phase takes an average of 3 to 5 working days, provided that all the products in your order are available. This period may change if one or more products in the order are temporarily unavailable. If any of the products are out of stock, you will be notified about the shipment of the remaining items in your order, and a refund will be issued for the unavailable product(s). If all products in the order are out of stock, the order will be cancelled and a full refund will be issued.
If you need the products you have ordered by a specific date, you should always contact FarmaOli to check whether this is possible.
FarmaOli only ships orders on working days according to the Portuguese national calendar. The estimated delivery time varies depending on the weight, carrier and destination of your order. Please note that the estimated delivery time should only be considered after the order has been shipped.
• European Community countries:
Provided all items are available, orders placed and paid for by 13:00 GMT are usually shipped the same day. After this time, they are shipped the next working day. The estimated delivery time is 7 working days.
• Countries outside the European Community:
Provided all items are available, orders placed and paid for by 13:00 GMT are usually shipped on the same day. After this time, they are shipped on the next working day. The estimated delivery time is 15 working days.
Delivery times may change during certain busy periods (Christmas, public holidays, Black Friday, etc.). We therefore recommend that you plan your purchases in advance during these periods so that you can receive all your orders on time.
Estimated delivery times are estimates and not guarantees. Several factors beyond our control, such as local customs procedures regulated by government guidelines, may influence these times.
The delivery time indicated does not include the time required for customs clearance in the destination country, especially for orders outside the European Union. Each country's customs regulations and processes may affect delivery times. For international orders, especially outside the European Union, customs inspections may cause additional delays.
Any delay in the shipment of items, compared to the estimated dates provided, does not entitle you to compensation. If the above-mentioned average delivery times are exceeded and the order is not received by the customer, you should contact us by email so that we can investigate the reason for the delay.
If it is not possible to immediately identify the reason for the delay, an investigation will be opened with the respective carrier. The maximum response time is 30 days. Only after the investigation process has been completed, and it has been concluded that the order was not delivered for reasons beyond the customer's control, will a new shipment or refund be made.
FarmaOli shall not be liable for any failure or delay in fulfilling any shipping obligation caused by an event, act or omission beyond its reasonable control.
Delivery of orders occurs when the consumer acquires control or physical possession of the goods.
When FarmaOli ships the goods to the consumer, the risk of loss or damage to the goods is transferred to the consumer when the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the goods.
Upon delivery, the customer must inspect the packaging and the products shipped to check for any damage, following these procedures: Inspect the packaging of the order. If you find any signs of damage (dented, open, torn, missing products, etc.), you must refuse the order. Once delivered, the order cannot be refused.
If the packaging is intact, accept the order, but check the contents for integrity and anomalies. If you see any damage (broken, dented, wet, leaking, missing products, etc.), record these anomalies in detail, specifying which products are damaged. FarmaOli will refund the amounts paid for the damaged products as soon as it receives the information from the carrier at its headquarters and completes the return process.
If you receive a damaged package/product and do not follow these procedures, FarmaOli will not be responsible for the damage to the item(s) ordered.
If the customer provides an incorrect or incomplete delivery address, is absent, fails to collect the order or refuses to accept delivery of all or part of the order, they will be liable for any deterioration of the products, shipping costs and payment fees incurred by FarmaOli. These amounts will be deducted from the refund for the order.
For payments by PayPal, Revolut or credit card, FarmaOli charges a usage fee that varies depending on the total value of the order. These amounts will be deducted from the refund for the order.
For reasons of health protection, susceptibility to deterioration and impossibility of return, food supplements, food and medical devices that are part of the order are not refundable.
10. Shipping methods and conditions:
International shipping:
The shipping cost and delivery time depend on the weight, delivery location, and shipping method selected by the customer. You can check this information directly in your shopping cart before proceeding to checkout. Any changes made by the customer to the products in the cart may result in changes to the shipping costs.
We do not deliver to PO boxes.
Please note that bulky or excessively heavy orders are subject to consultation and analysis of shipping feasibility.
If your order does not fall within the weight and volume parameters imposed for each shipping method, our customer support team will contact you for further information and assistance.
11. Authorization to Enter the Destination Country
All products and brands available on our website are authorised for sale and consumption in Portugal and comply with the regulations established by Infarmed and DGAV (Portuguese Regulatory Authorities). It is the customer's responsibility to check whether there are regulations in their country that limit or prohibit the import and consumption of certain products or substances, or whether there are limits on the number of units that can be imported.
For orders that are not permitted to enter the country, the following conditions apply:
• Refunds: A refund for the value of the products will only be issued after the order has been returned to our facilities. This refund will be processed according to the original payment method used for the purchase or in accordance with the options in our refund policy. Shipping costs and any customs duties or taxes associated with the return process will be deducted from the refund amount.
• Destruction of Goods: If the order is destroyed due to customs regulations or cannot be returned to our facilities, no refund will be issued.
We emphasise the need for customers to ensure compliance with all local regulations in order to avoid potential problems with customs and delivery of their order.
12. Tracking
As soon as we ship your order, you will receive an email with the tracking number that will allow you to track the delivery status.
13. Insurance
All shipments are covered by insurance against loss. If your order is lost, FarmaOli will refund the total amount of the order or send a second shipment at no additional cost. The order can only be considered lost after confirmation by the shipping company.
14. Customs Duties and Taxes in the European Union
No additional taxes or customs duties are charged on items shipped to countries within the European Union. Item prices and shipping costs include VAT and are therefore listed as gross prices.
15. Customs Duties and Taxes Outside The European Union
All taxes, customs duties and customs fees resulting from shipping are the responsibility of the customer. All items are shipped DDU – Delivery Duties Unpaid.
In addition, any additional fees or shipping costs not previously authorised will be deducted from the customer's refund.
