This document regulates the terms and conditions of use of this website and the agreement established between FarmaOli and the Customer. These Terms establish the rights and obligations of all users and FarmaOli in relation to the goods/services made available on this website or on any other website to which there is a hyperlink/link.
Before finalizing an order, you should read these Terms carefully. If you do not agree with them in their entirety, you should refrain from making any purchase.
These Terms are subject to change, so you should read them before placing any order. If you have any questions about these Terms, you should contact us by email at info@farmaoli.pt.
These Terms are important for both parties, as they aim to protect the rights of the user, as a customer, as well as our rights as FarmaOli and are intended to establish a legally valid agreement between the parties involved.
By placing an order, the user confirms that he/she has read these Terms, which he/she accepts without reservation.
The user agrees that:
You may only use this website to make inquiries or orders that are legitimate. You will not place orders that are speculative, false or fraudulent. If we have reasonable grounds to believe that a particular order is of such nature, we reserve the right to cancel it and inform the competent authorities.
You are required to provide an email address or other contact details that are correct and complete and you agree that FarmaOli may contact you using these details if deemed necessary. If you do not provide all the information deemed necessary, it may not be possible to complete your order and/or guarantee a quality service.
The information contained in these Terms does not constitute a sales proposal, but rather a mere invitation to negotiate. No contract relating to the products mentioned will be established between FarmaOli and the User without the order having been accepted by the former (regardless of whether or not a debit has been made to the User's account). If the order is not accepted after any debit has been made, the respective amount will be refunded in full.
When placing an order through this website,the user declares that he/she is over 18 years of age and has the legal capacity to enter into contracts.
1. Obligations of Customers and Users
Any visitor to the website www.farmaoli.com is obliged to comply with and respect these general conditions, namely:
- Save and do not disclose your password to enter the website, in order to prevent third parties from accessing your account and personal data;
- Do not use false identities;
- Provide your personal data and correct addresses so that orders can be properly processed;
The customer is solely responsible for the veracity of the personal data communicated to Farmaoli undertakes to immediately enter and inform any changes through its Registration Account at www.farmaoli.com.
Farmaoli is exempt from any responsibility for any delay or impossibility of processing the order due to error or insufficiency of the data communicated by the “End Consumer”, particularly at the time of delivery.
2. Information on the products sold
All products sold by FarmaOli are 100% genuine, purchased directly from manufacturers, and comply with European standards and formulas. We highlight that European cosmetic formulations may differ from those available in other regions. Customers should be aware of these possible differences when placing an order, as FarmaOli does not issue refunds for such variations unless the product is proven to be defective or not as described. This policy acknowledges regional differences in product formulations and packaging, which are common in the cosmetics industry.
The information on the website may contain typographical errors or inaccuracies and may not be complete or up-to-date. We therefore reserve the right to correct errors, inaccuracies or omissions, and to change and update information at any time without prior notice (including after your order has been shipped). Please note that such errors, inaccuracies or omissions may relate to the description, price and availability of the product. We apologize for any inconvenience this may cause. If you are not completely satisfied with your purchase, You may return it subject to the conditions in force. Please consult the Return Policy (Returns and Refunds).
The photographs shown on the website are merely illustrative and are intended to help identify the type of product, but may not accurately represent the product received.
Manufacturers frequently update product packaging, and as such, there may be differences in appearance, packaging language or ingredient list. In addition, the colours in the photographs may not correspond to the current colours of the products, and may also vary depending on the screen. Therefore, you should always consult the product description for more information about the respective characteristics of the items you wish to purchase.
For questions about a product, including details about ingredients or packaging, we recommend that customers contact our customer service team before placing their order by email at info@farmaoli.pt.
By purchasing from FarmaOli, customers acknowledge and accept these Terms, confirming that they are aware that product images and descriptions may vary from the products received due to updates and regional differences.
For proof of offer, discount or internal control, products may be shipped without barcode and/or CNP. If you do not wish to have these elements removed, you must contact FarmaOli before making the purchase.
3. Prices
FarmaOli offers a conversion service for several currencies. This service is provided only as an indicator. Your purchases are always debited in euros.
The prices of products displayed on the website are inclusive of Value Added Tax (VAT) and are correct at the time the information is entered into the system. However, we reserve the right to change prices at any time without prior notice.
If the price displayed on the checkout page is incorrect, we are not obliged to sell the products at the price displayed. We endeavour to ensure that the prices of products displayed on our website are correct, however, errors may occasionally occur. If we discover that there is an error in the price of the products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or requesting that we cancel it.If we are unable to contact the customer, the order will be cancelled and the customer will be refunded the full amount of the order, if already paid.
We reserve the right to refuse orders based on their size or value.
If you cancel your order and have already paid for the products, you will receive a full refund.
We would like to point out that all campaigns and promotions are limited to existing stock and are not cumulative.
Shipping costs will be borne by the customer and are at the amounts indicated at the time of ordering.
4. Value Added Tax
In accordance with current rules and regulations, purchases made through this website are subject to Value Added Tax (VAT). The Portuguese VAT rate is applied to orders placed by private consumers residing in Portugal or any other country in the European Union.
Retail prices, whether for an individual or a company, include Value Added Tax (VAT). In the case of companies that present a valid tax number, the Portuguese VAT rate is not applied. To ensure compliance with Portuguese Law, the tax number must be verified by our customer service before the order is completed.
Although rare, a customs fee may be charged in the destination country in accordance with the laws in force of that country. It is the sole responsibility of the customer to pay it.
5. Payment Methods and Security Guarantees
The available payment methods are: PayPal, Credit Card, MBWay and Multibanco Reference (?).
You can make the payment with Visa and MasterCard cards or through a Paypal account.
By making the payment, the user is confirming that he/she is the holder of the card or PayPal account, the authorized amount will be debited at that moment.
Credit cards are subject to validation checks and authorization by the issuing entities, but if the card issuer does not authorize the payment, FarmaOli will not be held responsible for any delay or lack of delivery and may not enter into the Contract with the user
We will only start processing the order after we have received the payment. If the customer selects the Multibanco Reference payment option, if payment for the order is not made within 4 days of placing the order, the order will be cancelled (?).
7. Placing an order
To place an order, the customer must have a valid and frequently used email account and must register as a customer by filling in the form available online. Once registered, simply add all the products you wish to purchase to the virtual shopping basket, following all the purchase steps for the purchase to be completed successfully.
As soon as you complete the purchase, you will receive an automatic email confirming the respective payment. We suggest that you print or download it. If the data is incorrect, you can immediately request that it be changed or even cancel the purchase made.
In the event of non-confirmation of payment or non-compliance with these General Terms and Conditions of Sale, FarmaOli reserves the right not to accept your order or to cancel it in whole or in part, even after automatic confirmation.
8. Product availability
FarmaOli only processes the order placed by a customer after confirmation of the respective payment.
Information on product availability refers to the moment the customer makes the purchase. Only after payment confirmation is the final validation of stock availability made. It is therefore advisable to pay immediately after placing the order.
Fulfillment of all orders placed on the website is subject to product availability. FarmaOli reserves the right not to accept any orders or to cancel orders already confirmed for products that are no longer in stock. In the event of product unavailability and/or stock shortage, FarmaOli will inform the customer of the partial or total cancellation of their order, and the customer is entitled to a refund of the amount paid.
9. Confirmation or cancellation of orders
FarmaOli will cancel orders when the customer does not make payment within the stipulated period, when the order is incomplete or incorrect, or when the products ordered are no longer available. In any of the cases referred to,FarmaOli will inform the customer via email that the sales contract has not been concluded and that FarmaOli has not proceeded with the sale, specifying the reasons for this.
If an order has been placed, and payment has been made, for products that have since become unavailable, FarmaOli will refund the amount paid for the unavailable items.
FarmaOli reserves the right to refuse any order, regardless of the reason and is exempt from liability for any damages or costs, and reserves the right to cancel any purchase even if it has already been accepted or confirmed by FarmaOli, in particular in the following situations:
- The information contained in the customer form is not correct or verifiable;
- Payment for the order is not made within a period of 5 working days following the order being placed (?); - (which methods and how many days exactly)
- When it is not possible to deliver the order to the address provided by the customer;
- If it is found that there was an error in the presentation of the price of the product(s)
Before shipping, the customer can request the cancellation of the order. If the customer places an order and wishes to cancel it, they must first check the order status through the “Order History” menu. If the order status does not mention “Shipped”, then there may still be a possibility of it being cancelled. To do so, the customer must contact FarmaOli by email and request the cancellation of the order. The cancellation will only be effective after confirmation by FarmaOli.
If the cancellation request is successful, the customer will be notified by email of this decision and the cancellation will be processed.
If the cancellation request is not possible because the order has already been shipped, the products will be sent to the customer who, if he/she maintains his/her intention, must exercise his/her right to freely terminate the contract.
For reasons of health protection, hygiene, susceptibility to deterioration and impossibility of reshipment, dietary supplements, food and medical devices are exceptions to the right to freely terminate.
Whenever there is room for cancellation of orders, at the customer's request, paid by Paypal, credit card, MB Way or multibanco reference, the amount to be refunded will be discounted by the usage fee paid by FarmaOli.
Whenever orders are cancelled, at the customer's request, the refund will be made using the same payment method used in the original order (except for orders paid by ATM reference, in which case the refund will be processed via bank transfer). The bank charges associated with the refund will be borne by the customer. In other words, you will receive the amount paid minus the costs involved in the transfer.
10. Preparation and Delivery of Orders
Unless otherwise agreed between the parties, FarmaOli will fulfil the order within a maximum period of 30 days, counting from the day after the actual payment of the order.
Shipments do not include the time required for carrier procedures caused by an event, act or omission beyond their reasonable control.
Only orders worth more than €5, excluding VAT, will be processed.
After your order has been registered and payment has been confirmed, the order enters the preparation phase. This phase takes on average 3 to 5 business days, and all the products in your order will be available. This period may change if one or more products in the order are temporarily unavailable. If any of the products are out of stock, you will be notified that the remaining items in your order have been shipped, and a refund will be issued for the unavailable product(s). If all the products in the order are out of stock, the order will be cancelled and a full refund will be issued.
If you need the products ordered for a specific date, you should always contact FarmaOli to check if this is possible.
FarmaOli only ships orders on business days in the Portuguese national calendar. The estimated delivery time varies depending on the weight, carrier and destination of your order. Please note that the estimated delivery time should only be considered after the order has been dispatched.
• Mainland Portugal:
If all items are available, orders completed and paid for before 13:00 GMT are generally dispatched on the same day. After this time, they are dispatched on the next business day. The estimated delivery time is 1 to 2 business days.
• Madeira and Azores Islands:
If all items are available, orders completed and paid by 13:00 GMT are generally dispatched on the same day. After this time, they are dispatched on the next business day. The estimated delivery time is 5 business days for Madeira and 7 to 11 business days.
• European Community Countries:
If all items are available, orders completed and paid by 13:00 GMT are generally dispatched on the same day. After this time, they are dispatched on the next business day. The estimated delivery time is 7 working days.
• Countries outside the European Community:
If all items are available, orders completed and paid by 13:00 GMT are generally dispatched on the same day. After this time, they are dispatched on the next working day. The estimated delivery time is 15 working days.
• Brazil:
If all items are available, orders completed and paid by 13:00 GMT are generally dispatched on the same day. After this time, they are dispatched on the next working day. The estimated delivery time is 12 to 20 working days.
Delivery times may change during certain periods of high demand (Christmas, holidays, Black Friday, etc.). We therefore recommend that, during these periods, you place your purchases in advance so that you can receive all orders on time.
The estimated delivery times are estimates and not guarantees. Various factors beyond our control, such as local customs procedures regulated by government guidelines, may influence these times.
The indicated delivery time does not include the time required for customs clearance in the destination country, especially for orders outside the European Union. Customs regulations and processes in each country may affect delivery times. For international orders, especially outside the European Union, customs inspections may cause additional delays.
Any delay in the dispatch of items, compared to the estimated dates presented, does not give rise to the right to compensation. If the average times mentioned above are exceeded and the order is not received by the customer, they should contact us by email so that we can ascertain the reason for the delay.
If it is not possible to immediately identify the reason for the delay, an investigation process will be opened with the respective carrier. The maximum response time is 30 days. Only after the investigation process has been completed, and it is concluded that the order was not delivered for reasons beyond the customer's control, will a new shipment or refund be made.
FarmaOli will not be liable for the failure to comply with, or delay in complying with, any shipping obligation caused by an event, act or omission beyond its reasonable control.
Orders will be delivered when the consumer acquires control or physical possession of the goods.
When FarmaOli sends the goods to the consumer, the risk of loss or damage to the goods is transferred to the consumer when the consumer or a third party indicated by the consumer, other than the carrier, acquires physical possession of the goods.
At the time of delivery, the customer must inspect the packaging and the products sent in order to check for any damage, following the following procedures: Inspect the packaging of the order, if you find that there are signs of the order presenting anomalies (dented, open, torn, non-existent products, etc.) you must refuse the order. The order cannot be refused once delivered.
If the packaging is intact, accept the order, but check the contents anyway - integrity and anomalies. If you notice any damage (broken, dented, wet, leaking product, missing product, etc.), please specifically record these anomalies, specifying which products are damaged. FarmaOli will refund the amounts paid for the damaged products as soon as it receives the information from the carrier at its headquarters and completes the return process.
If you receive a damaged package/product and do not carry out these procedures, FarmaOli will not be liable for any damage to the item(s) ordered.
If the customer provides an incorrect or incomplete delivery address, is absent, does not collect or refuses to accept delivery of all or part of their order, they will be liable for the deterioration of the products, shipping costs and payment fees incurred by FarmaOli. These amounts will be deducted from the order refund.
For payments made by Paypal, credit card, MB Way and Multibanco reference,FarmaOli supports a usage fee with a variable value depending on the total value of the order. These amounts will be deducted from the order refund.
For reasons of health protection, susceptibility to deterioration and impossibility of reshipment, food supplements, food and medical devices that are part of the order are not refundable.
11. Shipping methods and conditions:
For Mainland Portugal:
Home deliveries or via Pick UP Network:
• For orders under €40, the shipping fee is €2.45
• For orders over €40, shipping is FREE
International shipping:
The shipping cost and delivery time depend on the weight, delivery location and shipping method selected by the customer. You can check this information directly in your shopping cart before proceeding to payment. Any changes that the customer makes to the products in the cart may result in changes to shipping costs.
Free shipping is available for orders worth €110 or more, or the equivalent amount in the currency of the respective country, with a total order weight of less than 5 kg (including the weight of the products, protective material and respective cardboard box). In this case, the shipping method will be determined by FarmaOli, and the customer cannot choose. If you wish to select your preferred shipping method, your order will no longer benefit from the free shipping cost.
We do not deliver to PO boxes.
Please note that bulky or excessively heavy orders (e.g. nappies, pads, large gift sets, etc.) are subject to consultation and analysis of shipping feasibility.
If your order does not fall within the weight and volume parameters imposed on each method, our customer support team will contact you for further information and assistance.
12. Authorization to Enter the Destination Country
All products and brands available on our website are authorized for sale and consumption in Portugal and comply with the regulations established by Infarmed and DGAV (Portuguese Regulatory Authorities). It is the customer's responsibility to check whether there are regulations in their country that limit or prohibit the import and consumption of certain products or substances, or whether there are limits on the number of units that can be imported.
For orders that are not permitted to be imported, the following conditions apply:
• Refunds: A refund for the value of the products will only be issued after the order has been returned to our facilities. This refund will be processed according to the original payment method used for the purchase or in accordance with the options in our refund policy. The refund amount will be deducted from the shipping costs and any customs fees or taxes associated with the return process.
• Destruction of Goods: If the order is destroyed due to customs regulations or cannot be returned to our facilities, no refund will be issued.
We emphasize the need for the customer to ensure compliance with all local regulations in order to avoid potential problems with customs and delivery of your order.
13. Tracking
As soon as we ship your order, you will receive the tracking number by email that will allow you to track the status of the delivery.
14. Insurance
All shipments are covered by insurance against loss. If your order is lost, FarmaOli will refund the full amount of the order or make a second shipment at no additional cost. The order may only be considered lost after confirmation by the shipping company.
15. Customs Duties and Taxes in the European Union
No additional taxes or customs duties are charged on items shipped to countries within the European Union. Item prices and shipping costs include VAT and are therefore listed as gross prices.
16. Customs Duties and Taxes OUTSIDE THE EUROPEAN UNION
All taxes, duties and charges are included in the price list.Customs duties and taxes resulting from shipping are the responsibility of the customer. All items are shipped DDU – Delivery Duties Unpaid.
In addition, any additional fees or shipping costs not previously authorized will be deducted from the customer's refund.
